1. SCHEDULING & CONFIRMATION
1.1. Provider will send a confirmation email to Client one (1) business day prior to the scheduled deposition.
1.2. If Client does not respond by 5:00 PM, the deposition will be deemed confirmed.
1.3. Scheduling is subject to availability and is reserved on a first-come, first-served basis.
2. CANCELLATION POLICY
2.1. Inside 24 hours: Full Appearance Fee will be charged.
2.2. No Show or On-Site Cancellation: Full day rate will be charged.
These fees are mandatory and billed to the scheduling party.
3. PRODUCTION & TURNAROUND
3.1. Production Turnaround: 2-3 business days after receipt of full payment. Rush editing options are available at additional cost.
3.2. Synced Videos: Delivered within 2 business days after Provider receives the ASCII transcript.
3.3. Non-Production Clients: Standard delivery within 48 hours.
3.4. Turnaround time begins only after full payment is received.
3.5. Delivery delays due to missing materials are not the responsibility of Provider.
4. PAYMENT TERMS
4.1. Invoices are due within 30 days of issue.
4.2. A late fee of 1.5% per month applies to overdue balances.
4.3. Final video files will not be released until payment is received in full.
4.4. Client is responsible for all fees associated with collection of unpaid invoices.
5. SERVICE AREA & RATES
5.1. Standard rates apply to Tampa, Lakeland, Winter Haven, and surrounding Central Florida areas.
5.2. Travel outside this area may incur additional charges.
5.3. Rates are subject to change with 30 days’ notice.
5.4. Production rates start at setup and are based on time spent on-site or online
6. DELIVERABLES
6.1. Video formats are delivered via secure cloud link unless otherwise arranged.
6.2. Delivery links remain active for 14 days after delivered; re-delivery fees may apply.
6.3. Provider retains video files for 2 years. After this period, archives may be deleted unless a paid extension is arranged.
6.4. Provider will retain video files for 7 years as a paid extension.
7. PROFESSIONAL STANDARDS
7.1. Provider will record depositions following applicable federal and state rules.
7.2. Provider is not responsible for issues outside Provider’s control.
7.3. Client is responsible for participant compliance.
7.4. Provider agrees to maintain confidentiality of all recorded materials and will not share footage with third parties except the ordering party or as required by law.
7.5. Client agrees to provide facility access at least 60 minutes prior to the scheduled start time for equipment setup. Late access may result in delayed start or additional charges.
8. STANDBY / OVERTIME
8.1. A standby rate applies when proceedings are delayed more than 15 minutes beyond the scheduled start time.
8.2. Overtime rate applies to any proceedings that begin before 9:00 AM or continue past 5:00 PM
9. LIMITATION OF LIABILITY
Liability is limited to the total amount paid. Provider is not responsible for consequential damages.
10. GOVERNING LAW
This Agreement is governed by the laws of the State of Florida.
11. ACCEPTANCE
By scheduling a deposition, Client agrees to all terms.
